Terms & Conditions
By purchasing a session, the client acknowledges that they have received, read, and agreed to all terms outlined in this agreement and will communicate the details of the contract to any and all subjects or parties involved.
Service Agreement and Liability
The client agrees that Emmanuel "JR" Reyes (hereinafter referred to as "the photographer") will provide photography services to the best of their abilities according to the portrait, real estate, or event photography session selected. Every effort will be made to ensure satisfaction in line with industry standards. The photographer’s artistic interpretations will be considered acceptable and correct.
The photographer is not responsible for dissatisfaction due to circumstances beyond their control, such as subject behavior, weather, staging issues, or unforeseen interruptions. If equipment malfunction, data loss, or other technical issues prevent image delivery, liability will be limited to a reshoot (if possible) or a refund of the session fee. If the session fee is refunded, the photographer will have no further obligations to the client.
Payment Policy
A non-refundable retainer is required upon booking to secure the session date. The remaining balance is due on the day of the session or event. Images will not be delivered until full payment has been made.
Reschedules and Cancellations
Reschedules are only allowed for valid reasons (e.g., illness, emergency). If the client requests a reschedule, the full session fee will still be charged on the original appointment date. Additional reschedules will incur a $50 fee, and postponements beyond 8 weeks will incur an extra $50 fee.
Cancellations made within 48 hours of the session will result in the full session fee being charged. No-shows will also be charged in full. If the client fails to schedule a new session within two weeks of the initial reschedule, the session will be marked as a no-show.
Copyright and Reproduction
All photographs taken remain the exclusive property of the photographer. Clients will receive images via digital download and may print or use them for personal, professional, or promotional purposes, within these guidelines:
Portrait & Event Photography: Images may be shared online or on social media with credit to the photographer where possible.
Real Estate Photography: Clients may use images for MLS listings, social media, and marketing purposes but may not sell or transfer them to third parties without written permission.
The client may not edit, sell, or claim the images as their own. It is recommended that the client back up all final images upon delivery.
Liability Release
The photographer is not liable for any injuries, accidents, or damages that occur during the session.
Portrait and Event Sessions: Outdoor locations may present risks such as uneven terrain, insects, or urban hazards. The client is responsible for their own safety and the safety of any participants.
Real Estate Sessions: The photographer is not responsible for damage to property or belongings. Any issues with property access may reduce shooting time or result in additional fees.
If the client feels uncomfortable during any part of the session or event, they are encouraged to communicate this immediately to the photographer.
Model Release and Usage Rights
The client grants the photographer permission to use images from portrait, real estate, and event sessions for portfolio purposes, promotional materials, and social media unless otherwise specified in writing. No compensation will be provided for the use of these images.
The client may revoke this consent at any time by notifying the photographer in writing. Once notified, the photographer will cease using the client’s images in future promotional material.
Reshoot Policy
Reshoots are offered at the photographer’s discretion and are not guaranteed for circumstances outside the photographer’s control (e.g., subject behavior, poor weather, inadequate staging).
Portraits & Real Estate: A reshoot will be offered only if the property or subjects were not presented as agreed.
Events: Due to the nature of event photography, reshoots are not typically offered. The photographer will make every effort to capture important moments, but certain moments or guests may be missed due to the flow of the event.
If a reshoot is arranged, the original session time and conditions will apply. For portrait sessions, a $200 fee will apply if the client wishes to receive both the original and reshoot galleries.
Session Details and Terms
Portrait Photography
Sessions will take place on Fidalgo Island and surrounding areas. Travel fees may apply for locations outside of this region.
Session time includes outfit changes, if applicable. Additional hours can be added at $150/hour.
The photographer aims to deliver 10-100 images depending on the package selected, and a download link will be provided for access to the final images.
Real Estate Photography
Properties must be clean, organized, and staged prior to the scheduled session. The photographer will capture a variety of images optimized for marketing and MLS listings.
Sessions will be limited to the agreed-upon time, with additional hours billed at $150/hour. Travel fees apply for properties located more than 20 miles from the 98221 zip code.
If access is delayed or restricted, the photographer may charge additional fees or reduce shooting time.
Event Photography
The photographer will capture key moments of the event, but the client acknowledges that not every moment or guest can be photographed.
Additional hours beyond the contracted time are billed at $150/hour.
The number of delivered images will vary based on the length and type of event, with a typical range of 100-500 images.
Travel fees may apply for events outside of the Anacortes area.
Storage Policy
Due to the volume of work, the photographer retains RAW image files for 90 days after the session or event. JPEGs will be archived, but it remains the client’s responsibility to back up the final images promptly after delivery.
Editing
The photographer’s editing style emphasizes natural tones with basic corrections such as color adjustments, contrast, and artistic enhancements. Any additional or custom edits will be billed at $150/hour.
Real Estate: Images will be optimized for MLS standards. Requests for advanced retouching or virtual staging will incur additional fees.
Event: Event photos will reflect the candid and documentary nature of the event, with minimal retouching.
Portraits: The photographer will make basic corrections. However, additional retouching requests (e.g., skin smoothing or body modifications) will be charged separately.
By completing the booking form and submitting payment, the client acknowledges that they have read, understood, and agreed to the terms outlined in this agreement. The client agrees to communicate the terms to any relevant parties involved in the session or event.
